<p>The official 2010 Demographic Data released last month by
the FFIEC is now available to all Comply users. If you are using the
Auto-Updates feature of Comply, the update will automatically download to your
system and you'll just need to apply it. If you are not using
Auto-Updates, the update is available on the RATA Support Site at <a href="https://support.rataassociates.com/">https://support.rataassociates.com/</a>. For users running Comply version 7.7 or
higher, applying the new demographics file either way will re-link the geocodes
with the new demographics and re-calculate the FFIEC Borrower Income. </p>







<p><span style="font-weight: bold;">IMPORTANT </span>- If you are running version 7.6 of
Comply, you must perform two additional steps after applying the 2010
Demographics file to your system:</p>







<ol type="1" start="1">
	
	
	<li>Re-link
     all geocodes in the 2010 report year. Highlight one Reporting Entity
     at a time and go to ‘Tools > Geocoding > Link Applications > Link
     all applications’.</li>
	
	
	<li>Re-calculate
     the FFIEC fields in order to update the FFIEC Borrower Income for all
     applications. This will re-calculate the FFIEC fields for the entire
     system: ‘System > System Maintenance > Enter Advanced
     Option Code > 399519 > OK’.</li>


</ol>




<p>Again, the
steps above only need to be done if you are running Comply 7.6. If you
are running 7.7 or higher these steps will be done automatically during the
update of the demographic file.</p>

Also, if you have not
updated to the latest version of Comply - 7.8, we highly recommend you do so as
soon as possible since any version below 7.8 lacks the 2010 edit changes and
submission capabilities. If you have any questions regarding the proper

<title>Financial Reform and Effect on HMDA and CRA</title>

<p>As most of you are aware, the Financial Reform Bill has
passed both the House and the Senate as of July 15<sup>th</sup> and is waiting
to be signed into law by the President in the very near future. Although this Bill was created to “fix” Wall
Street, it encompasses much more and a portion of it affects HMDA, CRA and Fair
Lending.</p>




<p>We just want to let you know that RATA Associates is aware
of the changes to the regulations and we will be working diligently to update
the RATA Comply software to deal with all aspects of these changes well before
they go into effect.</p>




<p>First, it looks like the government will be creating a new
division to oversee HMDA and CRA called Bureau of Consumer Financial
Protection. We are not sure what affect
this will have on the current regulatory agencies or the FFIEC.</p>




<p>At one point, the government had language in the Bill to
have institutions geocode all Deposit accounts, ATM’s and Branches and have
institutions submit that data on an annual basis. It looks as though that language has been
taken out of the final Bill.</p>




<p>However, what remains affects both CRA and HMDA data
collection and submission. Section 1071
of the Bill deals with the CRA changes.
Most of these changes have to do with expanding the data that is
collected for Small Business lending to determine if the business applying for
credit is a woman or minority-owned business. The biggest change here will be the additional
collection of Race, Sex and Ethnicity fields which are currently prohibited. It also looks as though the scope of CRA will
be extended to include Credit Unions.</p>




<p>With regards to HMDA reporting, the additional fields are
substantial and look to be mostly related to the additional fields normally
collected for Fair Lending analysis. Changes
to HMDA are specified in Section 1094, and include but are not limited to, the
collection of <span style="font-weight: bold;">Age</span> (section 3 subsection A paragraph i), the collection
of <span style="font-weight: bold;">Points and Fees</span> (section 5 subsection A), rate spread (section 5
subsection B),<span style="font-weight: bold;"> term in months of any
prepayment penalty</span> (section 5 subsection C), appraised value
(section 6 subsection A), <span style="font-weight: bold;">fixed loan term</span> (section 6 subsection B), “<span style="font-weight: bold;">the
presence of contractual terms or proposed contractual terms that would allow
the mortgagor or applicant to make payments other than fully amortizing
payments during any portion of the loan term</span>” (section 6 subsection C), <span style="font-weight: bold;">full
loan term</span> (section 6 subsection D), “<span style="font-weight: bold;">the channel through which
application was made, including retail, broker, and other relevant categories</span>”
(section 6 subsection E), the <span style="font-weight: bold;">parcel number</span> (section 6 subsection H) and
the <span style="font-weight: bold;">credit score</span> (section 6 subsection I).</p>




<p>Additional data collection requirements are not specified in
the bill as provided, but a clause at the end of Title X states “The Bureau of
Consumer Financial Protection will also include an Office for Financial
Education and an Office the Financial Protection of Older Americans. In
addition, Title X provides for enhanced data collection required by HMDA and
ECOA.” </p>




<p>From what we can tell, these changes will be finalized over
the next few months and will actually go into effect January 1<sup>st</sup>,
2012. The good news is that RATA has
most of the new fields readily available in the RATA Comply software
already. The harder part will be on your
end trying to get the data into origination systems and exported to the RATA
system.</p>

<title>RATA Comply 7.8 Update To Be Released 5/17/2010</title>

<p style="MARGIN: 0in 0in 10pt" class="MsoNormal"><span style="FONT-FAMILY: Calibri; COLOR: #000000; FONT-SIZE: 12pt">We are currently in final QA testing of our RATA Comply 7.8 software update.&nbsp; The software is currently in Beta testing at a few client institutions and we are hoping to release to the general client base on Monday May 17th.&nbsp; This software update includes many fixes, enhancements and a few new features, as well as everything needed to collect, edit and submit your 2010 HMDA and CRA data.&nbsp; </span></p>

<p style="MARGIN: 0in 0in 10pt" class="MsoNormal"><span style="FONT-FAMILY: Calibri; COLOR: #000000; FONT-SIZE: 12pt">In order to perform this new update you will need to be using SQL Server 2005 or higher and you must be running .NET 3.5.&nbsp; If you are using SQL Express or MSDN, we have "free" upgraded versions available for you if needed.&nbsp; With these new changes, the system will no longer run under Windows 2000.&nbsp; We have notified all clients on multiple occasions over the last year&nbsp;that this change was coming and most if not all clients are ready for the new technical requirements. <p style="MARGIN: 0in 0in 10pt" class="MsoNormal"><span style="FONT-FAMILY: Calibri; COLOR: #000000; FONT-SIZE: 12pt">The Comply 7.8 update also contains our full release of the optional Comply Fair Lending – Advanced Analysis and Regression component.&nbsp; With this newest component, institutions now have the ability to create and run both multi-linear and logistical regression against their data to identify statistically significant risk areas.&nbsp; This newest component compliments the base Fair Lending component, which runs data through the FFIEC risk factors and produces “scorecards” that identify high risk disparities. Both components can help institutions identify applications that need to be reviewed by way of Comparative File Review (CFR) and then perform that function directly in Comply.&nbsp; <br />

<title>Submission Over, Fair Lending Taking The Spotlight</title>

<p style="MARGIN: 0in 0in 10pt" class="MsoNormal"><span style="FONT-FAMILY: Calibri; COLOR: #000000; FONT-SIZE: 12pt">Congratulations on another successful HMDA and CRA submission season.<span style="mso-spacerun: yes">&nbsp; </span>From conversations we have had with all of our clients, it looks like everyone submitted on time and error free! That is great news.</span></p>

<p style="MARGIN: 0in 0in 10pt" class="MsoNormal"><span style="FONT-FAMILY: Calibri; COLOR: #000000; FONT-SIZE: 12pt">Now the spotlight changes from data collection, clean-up and submission to analyzing your data, and Fair Lending Risk is the hot topic in the industry.<span style="mso-spacerun: yes">&nbsp; </span>Are you lending equally to prohibited basis groups? <title>Important Submission News if you submit both HMDA and CRA submissions.</title>
<description><![CDATA[It has come to our attention that there is a slight glitch in the HMDA submission if you do both HMDA and CRA submissions from the same Comply system.&nbsp; If your institution falls into this category, when you go to do your HMDA submission you will most likely get RATA Validity Edits (VR) regarding NA in the geocoding fields.&nbsp; <span style="font-weight: bold;">This only happens to HMDA reporters that also submit CRA</span>.&nbsp; If you end up in this scenario, you cannot submit without a quick work-around.<br />




<br />




To get around this situation, you will need to temporarily&nbsp;modify the CRA&nbsp;Respondent ID Number in the Transmittal information of the CRA&nbsp;Reporting Entity.&nbsp; All you have to do is temporarily change the last digit of the Respondent ID to a different number than the HMDA Reporting Entity.&nbsp; Once you do that, you can run the HMDA submission and as long as you have no other errors,&nbsp;the VR errors will disappear and the submission will work fine.<br />




<br />




Once your HMDA submission is complete, simply correct the Respondent ID in the CRA Reporting Entity&nbsp;and then you can proceed with the CRA submission.<br />

<title>2009 Geocode Redo Files are Complete</title>
<description><![CDATA[As part of our on-going commitment to geocoding excellence, every year we run a year end process to regeocode all addresses submitted throughout the year in order to obtain the highest precision level possible for every address before the official submission.&nbsp; In a nutshell, we regeocode all addresses submitted and then compare the results to see if the geocode was improved due to address updates in our geocoding process.&nbsp; Typically, customers can see anywhere from .05% to 3% improvement to the overall file precision of a submission file.&nbsp; Typcally you will be updating with a file thay could be 1-5% of your submission volume.&nbsp; <br />
<br />
For those of you that use Auto-Update to send and receive geocode files, you should get this file back automatically today or tomorrow.&nbsp; If you don't receive it or you do not use Auto-Update, you can retrieve the file from our support site and then apply as you normally do.&nbsp; These files can be identified by the week 70 naming scheme. They should be B????970.ZIP where ???? is your client ID.<br />

<title>IMPORTANT Submission Warning regarding RATE SPREADS!!</title>
<description><![CDATA[

<p>Hope all is going well with your submission preparation.&nbsp; We just discovered an issue with the Loan Term field (regarding Adjustable Rate Mortgages ARM) that may affect your file.&nbsp;&nbsp;This issue only affects ARM loans, so if you don't do ARM loans or only do a couple, it&nbsp;should not be hard to verify and/or correct.<br />
	<br />
	The issue has to do with the import functionality and how we are converting the Loan Term for Adjustable or Variable Rate loans.&nbsp; Somehow the date select condition did not get into the routine, so it is doing the Adjustable Rate processing on all ARM loans regardless if the Application Date is prior to 10/1/2009 or not.&nbsp; The fix for this issue is pretty simple, but we need to identify which customers&nbsp;this affects&nbsp;as well as&nbsp;how many applications, to give you a strategy to fix.<br />
	<br />
	There is one other scenario that can affect the applications with Application Dates after 10/1/2009 as well.&nbsp; If we helped you set up your Import Definitions and we put in code to convert the Loan Term, chances are we didn't put a date range in there either.&nbsp; So that situation will have to be corrected also if you do ARM loans.<br />
	<br />
	This will not be an issue going forward, just for this transitional period.&nbsp; We apologize for any inconvenience this may cause, but we are hoping the fix will be painless on a case-by-case basis.&nbsp; You will be contacted by a RATA Support Representative to try and ascertain your exposure and to help you determine the course of action to fix the issue based on your individual situation.<br />
	<br />
	If you need faster service please feel free to call us.&nbsp; One way to help is to run a few filters in Comply to see if you are affected.&nbsp; Simply go into your standard Application View, select the Additional Tab and then look at your Amortization Type.&nbsp; You will want to filter&nbsp;down to&nbsp;Adjustable (2)&nbsp;and that will tell you potentially how many applications are affected.&nbsp; Then you can sort by Application Date and look at a few with Application Dates before and after 10/1/2009 to make sure the correct Loan Term is showing.&nbsp; For ARM apps prior to 10/1/2009 the Loan Term should be the full Term.&nbsp; For ARM apps after 10/1/2009 the Loan Term should be the fixed portion only.<br />
	<br />
	If you don't use one of our conversion Import Definitions or the Virtual Amortization converter in the Import Wizard, then you shouldn't have an issue, but we recommend you check anyway to make sure your programmers have dealt with the situation correctly.<br />
	<br />
	Again, this should not be hard to fix.&nbsp; The hardest part is identifying the issue.&nbsp; As mentioned earlier, we will be contacting you but if you would like to deal with this sooner, feel free to call us at 407-831-7282.<br />

<title>Submission Season is here and we have resources to help!</title>

<p>As you all know, submission season is upon us!&nbsp; Your RATA support staff is here to help in any way we can, so feel free to call us with any questions or comments along the way.&nbsp; The first step toward a successful submission is to make sure you are running the submision version of Comply.&nbsp; To submit your 2009&nbsp;data, you must be on Version 7.6 of RATA Comply.&nbsp; This version has been out for a while now, so you should already be on it.&nbsp; Also remember the submission deadline is March 1, 2010 for both HMDA and CRA data!<br />

	To help you make sure you are processing your data correctly and to make sure you haven't missed any steps, we have created a few different resources that you may refer to at your convenience.&nbsp; <br />

	The first resources are our 2009 processing guides, which can be found direclty under the Resources section of the Start Page in Comply.&nbsp; There is one for HMDA (RATA 2009 HMDA Year End Processing Guide) and a seperate one for CRA&nbsp;(RATA 2009 CRA Year End Processing Guide).&nbsp; Both guides will explain step-by-step what you should be doing, give you a checklist to follow and provide the email addresses of where to send your submissions.&nbsp; If you haven't viewed these yet, you should do so at your earliest convenience.&nbsp; The guides will pull up as .PDF files, so you can just read them or print them out!<br />

They just released the official 2008 Public HMDA data.&nbsp; Now that we have received the data, the ball is in our court and we are hoping to have the data converted, uploaded to our peer system and tested by Monday October 5th.&nbsp; The 2008 CRA is already available at <a href="http://www.crapeer.com">www.crapeer.com</a> for those of you that are licensed.<br />

<title>Comply 7.6 Update Available</title>
<description><![CDATA[RATA Associates has just posted the Comply 7.6 update to the Support Site. Comply 7.6 contains all updates since the 7.1 release, so there is no need to perform any of the interim releases.&nbsp; All Comply users must update to the 7.6 update as soon as possible.&nbsp; This update is crucial in that it provides the HMDA Rate Spread Calculation changes effective October 1st, 2009 as well as providing the submission functionality needed for the 2009 HMDA and CRA submissions.<br />

Since Comply 7.6 includes the functionality to submit 2009 data, we are going to briefly delay the release of 8.0 until the spring of 2010, this gives users using SQL 2000 more time to switch to either SQL 2005 or SQL 2008 as required by the 8.0 software as well as those very few still using Windows 2000 time to upgrade to Windows XP or later.&nbsp; <br />

<title>Comply 7.6 Update in Final QA</title>

<p style="MARGIN: 0in 0in 0pt" class="MsoNormal"><span style="FONT-FAMILY: Calibri; COLOR: #000000; FONT-SIZE: 12pt">Comply 7.6 is now in the final Quality Assurance phase and is set to be released sometime next week.&nbsp; RATA Associates has come up with a new strategy for releasing updates whereas this release will contain everything needed to submit your 2009 HMDA and CRA submissions.&nbsp; In the past we would hold back submission features for the end of year updates, but we have found that strategy put unneeded stress on both our developers and the IT departments.&nbsp;&nbsp; By releasing the 2009 submission module now, all institutions will feel confident and relaxed through the submission season.

<title>Comply 7.5 Release News</title>

always, Comply 7.5 will contain all of the updates between 7.1 and this
latest release, so if you have not upgraded since 7.1 now would be a

<title>The New Rate Spread Calculations</title>

<p>Effective October 1, 2009, the new FFIEC Rate Spread Calculation will go into effect. These
changes were finalized last year and are designed to make the Home
Mortgage Disclosure Act (HMDA) reporting conform to the new Regulation Z
definition of "higher-priced mortgage loans."<br />

		As always, RATA Associates will keep you up to date with this change and any regulation changes that need to be dealt with. We
are in the process of updating RATA Comply to perform the new
calculations for the change. To properly calculate the new Rate Spread
you will only need to add one field to your current data export and
Import Definition. This field is the Amortization Type (1- Fixed, 2-
Variable). The rest of the fields needed already exist in the older
methodology. 
		</p>






<p>The
new Rate Spread calculation will be available in our version 7.6 Comply update
which is scheduled for release the first or second week of July. Our
Comply version 7.5 release (due out 5/15/2009) will have the new Amortization
Type Field implemented so that you can begin to modify your current
import files and Import Definitions, but it will not calculate the
new Rate Spread since it only affects applications with Action Dates
after October 1,<sup> </sup>2009.

<title>Comply 7.11 Update Available</title>

<div>A Comply Update is now available on our support site for those clients that wish to download and apply it.&nbsp; The Comply 7.11 update is not&nbsp;a critical update, but it does have quite a few fixes and enhancements to help you with the 2008 submission and the 2009 data processing.</div>

<div>The most significant change for the 2008 reporting cycle is the naming convention of the actual submission files.&nbsp; The government was expecting everyone to manually use their encryption program to encrypt the files so they did not mention that the naming convention had changed.&nbsp; We set up Comply to automatically Encrypt the file(s) but they are named the same as they have been in previous years.&nbsp; If you use Comply 7.1 to create your submission file, you will have to rename the file to the new naming convention.&nbsp; Version 7.11 will automatically&nbsp;name the files correctly.&nbsp; But, only the name has changed, the file formating and encryption are fine with 7.1.</div>
